What Builders and Employers Must Know About
The New Employee Verification Form I-9

What is a form I-9?

It is a document by law that EVERY employer is required to complete to verify the identity and work authorization of EVERY new employee.

 What is new about Form I-9

The Department of Homeland SEcurity has changed the old Form I-9. THe new Form I-9 eliminates five documents that were previously accepted as verification of identity and work authorization. These documents are:

  •  Certification of U.S. Citizenship (Form N-560 or N-561)
  • Certificate of Naturalization (Form N-550 or N-570)
  • Alien Registration Receipt Card (I-151)
  • Unexpired Reentry Permit (Form I-327)
  • Unexpired Refugee Travel Document (Form I-571)

Can I continue to use the old form?

No. The grace period for using the form expired 12/26/2007. Using the old form now can result in fines of $100 - $1100 per occurance.

Should I redo the Form I-9 for my existing employees?

No. The new Form I-9 is to be used only for new hires. the old Form I-9's filled out for current employees should NOT be discarded or redone.

What should I do with old blank Form I-9's in my filing cabinet?

Throw them away so that they are not used by accident.

The new Form I-9 can be downloaded from the U.S. Customs and Immigration Service website - www.uscis.gov
